A Davis developer filed a lawsuit on Sept 5 challenging DJUSD’s maximum school impact fee of $5.17 per square foot on the Palomino Place project—he claims the fee unfairly charges local homebuyers by funding schools for nonresident students and ignores enrollment declines.
The suit seeks to invalidate the fee by arguing that existing facilities can accommodate new students without the need for extra construction.
